Service Agreement
This Service Agreement ("Agreement") is entered into between Rising Phoenix ("Provider") and the Customer ("Customer") upon the purchase of the online course offered by the Provider. By purchasing and accessing the course, the Customer agrees to the following terms and conditions:
1. Access and Use 1.1 The Customer is granted a non-exclusive, non-transferable license to access and use the online course content solely for personal, non-commercial purposes. 1.2 The Customer agrees not to share, distribute, or disclose any course materials, login credentials, or other proprietary information with any third party.
2. Intellectual Property 2.1 All content provided in the online course, including but not limited to text, graphics, images, videos, and downloadable materials, is the intellectual property of the Provider. 2.2 The Customer agrees not to copy, reproduce, distribute, modify, create derivative works from, or publicly display any content from the online course without the express written permission of the Provider. 2.3 Any unauthorized use of the course material is a violation of this Agreement and applicable laws. Such violations may lead to immediate termination of this Agreement and further legal action.
3. Confidentiality 3.1 The Customer agrees to keep all course content confidential and not to disclose any information obtained from the course to any third party. 3.2 The Customer shall not use any information from the course for any purpose other than personal education and professional development.
4. Prohibited Conduct 4.1 The Customer shall not engage in any activity that disrupts or interferes with the proper functioning of the course website or other users' access to the course. 4.2 The Customer agrees not to attempt to gain unauthorized access to any part of the course website or any systems or networks connected to the course website.
5. Subscription Terms
5.1 Subscription Plans Rising Phoenix offers various subscription plans for our Services. These plans are billed on a recurring basis (e.g., monthly, annually) and will automatically renew at the end of each billing cycle unless you cancel your subscription.
5.2 Payment By subscribing to our Services, you authorize us to charge your payment method on a recurring basis without requiring your prior approval for each recurring charge, until you notify us of your cancellation.
5.3 Cancellation You may cancel your subscription at any time via your account settings or by contacting our support team. Your cancellation will take effect at the end of the current billing cycle, and you will have continued access to the Services until the end of that period.
5.4 Refunds Due to the nature of our subscription-based services, refunds are typically not provided. However, we will review refund requests on a case-by-case basis. Factors considered in the review will include the nature and quality of the service provided. To request a refund, please contact our support team detailing the reason for your request.
6. Technology Requirements 6.1 Access to the course requires reliable internet access.
7. Accessibility 7.1 Customers with accessibility needs should contact the Provider to discuss potential accommodations.
8. Course Content Updates 8.1 Updates to the course content may occur as deemed necessary by the Provider. Customers are encouraged to regularly check the course for updates.
9. Data Privacy 9.1 The Provider is committed to protecting the privacy and security of the Customer's data. Personal information will be handled in accordance with applicable data protection laws.
10. Dispute Resolution 10.1 Any disputes under this Agreement should first be addressed through direct conversation between the Customer and the Provider. If unresolved, disputes may be subject to mediation or arbitration as agreed upon by both parties.
11. Assignment 11.1 The rights and obligations of the Customer under this Agreement are personal to the Customer and may not be assigned or transferred to any third party.
12. Termination 12.1 The Provider reserves the right to terminate the Customer’s access to the course without notice if the Customer violates any terms of this Agreement. 12.2 Upon termination, the Customer must immediately cease all use of the course content and destroy any copies of the course materials in their possession.
13. Disclaimer and Limitation of Liability 13.1 The Provider makes no warranties, express or implied, regarding the accuracy, completeness, or suitability of the course content for any purpose. 13.2 The Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Customer's use of the course content.
14. Governing Law 14.1 This Agreement shall be governed by and construed in accordance with the laws of Australia & America, without regard to its conflict of law principles.
15. Entire Agreement 15.1 This Agreement constitutes the entire agreement between the Customer and the Provider regarding the purchase and use of the online course and supersedes all prior agreements and understandings, whether written or oral.
16. Amendments 16.1 The Provider reserves the right to amend this Agreement at any time. Any such amendments will be effective immediately upon posting on the course website.
