Assumption of Risk: I understand that participating with Rising Phoenix Academy of Performing Arts entails inherent risks of physical injury. I have been given the chance to ask questions and all such questions have been answered to my satisfaction. Having read this form, I am fully aware of the risks and hazards associated with taking part in Rising Phoenix
and hereby elect to participate. I assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me as a result of participating.

Liability Release: In agreeing to participate with Rising Phoenix, I will not sue Rising Phoenix and I release them from any and all liabilities, claims, demands, actions, causes of actions, costs and expenses of any nature whatsoever arising out of any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me, arising from undertaking participation or while upon the premises where training is being conducted, excepting those claims arising from their negligence or wilful misconduct of Rising Phoenix and it's employees.

Indemnification: I agree to indemnify and hold harmless Rising Phoenix and it's employees from and against any loss, liability, damage or costs, including court costs and attorneys’ fees, that may incur arising from my involvement in training & participation, excepting those claims arising from the negligence or wilful misconduct of Rising Phoenix.  

Warranty of Physical Fitness: I warrant that I am physically fit and in a condition that will allow me to participate fully with Rising Phoenix. I maintain medical insurance that covers me for accidents and illnesses while participating. I understand that Rising Phoenix has not made, nor will make, any investigation into my physical
fitness or ability to participate, and that Rising Phoenix is relying on my warranty of my physical condition. I assume full responsibility for payment of medical expenses not covered by my insurance incurred as a result of my participation.

Emergency Medical Treatment: I grant Rising Phoenix permission to authorise emergency medical treatment as it deems appropriate, and agree that such action by Rising Phoenix shall be subject to the terms of this Agreement. I understand and agree that Rising Phoenix assumes no responsibility for any injury or damage that might arise out of or in
connection with such authorised emergency medical treatment.

Cancellation: Rising Phoenix reserves the right to change or cancel a booking up to and including the date of the booking. If we, for any reason, are unable to attend a session or class, a voucher will be issued to rebook the session at no cost to you. If we are unable to offer a suitable alternative in the immediate future a credit will be applied to your account. 

In the event that you are unable to attend your booking, you must notify us with more than 24 hours prior to your lesson. Lessons cancelled with more than 24 hors prior will be 100% credited towards your next booking. Lessons cancelled less than 3 hours prior to your booking will be forfeited with no credit or refund available. 

Refund Policy: Refunds will only be granted in extreme circumstances. Rising Phoenix Academy of Performing Arts reserves the right to assess each request on a case-by-case basis, and our decision will be final.
